Representative Work

We represent a variety of clients – from individuals and startup operations to corporations doing business in the US, Canada and internationally. Examples of work include:

Assisting individuals in obtaining shoreline and other development approvals from local governments and agencies (large and small projects, ranging from single family residences to multi-family and master planned projects).
Assisting an internationally known real estate developer with local permitting and land use issues, including appeals under the State Environmental Policy Act (S.E.P.A.) and the Land Use Petition Act (L.U.P.A.), to create a "signature" waterfront development. This work included helping the local government refine its own public hearing process and adapting the project plans to ensure a community friendly project.

We assist Canadian businesses expanding into the US, and US businesses expanding into Canada. Examples of this work include:

Representing Gap, Banana Republic and Old Navy with their launch of retail stores into British Columbia, Canada (retail leasing).
Assisting a well-known Canadian restaurant chain with its launch of restaurant franchises into Washington State (commercial leasing, financing, and development).

We assist domestic US and Canadian corporations with their business transactions throughout the United States and Canada.

We assist residential, industrial and commercial real estate developers in the acquisition, permitting and construction of real estate projects throughout Washington State and British Columbia.

We have assisted clients in other projects as diverse as relocating utility power poles, obtaining approvals for short plats, resolution of surveying and title problems, creation of fishing lodges in the Queen Charlotte Islands, preparing businesses for sale, joint ventures with Indian tribes, preparation of conservation easements and documentation enabling independent power producers to connect to the North American power grid.

Negotiated the development management, partnership, construction and lease documents for a 40-story (500,000 sq. ft.) tower built on the waterfront in downtown Vancouver, B.C.

Represented British Columbia’s electric power generation and distribution utility in the $800,000,000 privatization of four of its divisions - B.C. Lower Mainland Natural Gas Distribution, Vancouver Island Propane Distribution, Short-haul Railway and R&D Divisions. Identified and organized the real estate and right of way interests needed to complete the sale of each division as stand-alone entities. Assisted in drafting the legislation needed for the privatization to proceed and negotiated the purchase and sale agreements for the Railway and Natural Gas Distribution transactions. Drafted complex post-closing operating agreements needed for the newly formed divisions to carry on business using assets that were shared with the power authority.

Negotiated significant concessions relating to a government taking. B.C. Transit agreed to lower its elevated rapid transit facility as it approached the client’s television broadcasting site, thus enabling the broadcaster to continue using its 400 feet of southern exposure to accommodate its satellite dish array, and saving millions of dollars in relocation costs and annual "back haul" charges from remote satellite dishes.

Permitting and construction of a multi-modal transportation facility located on a contaminated railway site.
