We have assisted clients in various other projects as diverse as relocating utility power poles, obtaining approvals for short plats, resolution of surveying and title problems, creation of fishing lodges in the Queen Charlotte Islands, preparing businesses for sale, joint ventures with Indian tribes, preparation of conservation easements and documentation enabling independent power producers to connect to the North American power grid.

Major Files:

Negotiated the development management, partnership, construction and lease documents for a 40-story (500,000 sq. ft.) tower built on the waterfront in downtown Vancouver, B.C. (acting for the development subsidiary of one of Canada’s largest construction companies).

Represented British Columbia’s electric power generation and distribution utility in the $800,000,000 privatization of four of its divisions - Natural Gas Distribution, Vancouver Island Propane Distribution, Short-haul Railway and R&D Divisions. Identified and organized the real estate and right of way interests needed to complete the sale of each division as stand-alone entities. Assisted in drafting the legislation needed for the privatization to proceed and negotiated the purchase and sale agreements for the Railway and Natural Gas Distribution transactions. Drafted complex post-closing operating agreements needed for the newly formed divisions to carry on business using shared assets with the power authority.

Negotiated significant concessions relating to a government taking. The lowering of an elevated rapid transit facility as it approached my client’s television broadcasting site enabled my client to continue using its 400 feet of southern exposure to accommodate its satellite dish array.

Permitted and built a multi-modal transportation facility located on a contaminated railway site.
